A “Message to Loved Ones” or “Message of Love and Endearment” is a personal expression from the testator to their family members or beneficiaries. These messages often reflect the testator’s emotions, include words of encouragement, religious blessings, prayers, or personal advice intended to comfort and inspire their loved ones.
While such messages are heartfelt and meaningful, they are not legally binding and must not contradict the express legal provisions of the Will.
To avoid confusion or unintended consequences, the following guidelines should be observed:
- Avoid Negative or Hurtful Comments
The message should not be used to express grievances, settle disputes, or revisit unresolved conflicts. Negative statements may cause emotional distress and undermine family unity. The tone should remain loving, positive, and constructive.
- Do Not Contradict the Will
Personal messages should not conflict with the legal terms of the Will.
Example (to avoid): “I wish this property went to someone else,” when the Will legally names a specific beneficiary. Such remarks may lead to disputes or misinterpretation.
- Avoid Giving Legal Instructions or Distributing Assets
The message should not contain directions that imply the giving of property or impose obligations on others.
Example (to avoid): “I give SGD10,000 to you; please pass it to my brother.” This may confuse the distribution scheme and complicate administration.
Including a loving message in your Will is a beautiful way to offer comfort and express lasting affection. When done thoughtfully, it adds a personal and emotional dimension that your loved ones will treasure.
